These Affiliate Programme Terms & Conditions (“Terms”) govern your participation in the Homexdesign Affiliate Programme (“Programme”).
“Homexdesign”, “we”, “us” or “our” refers to Homexdesign, a brand operated by S.A. Brass Collection. “Affiliate”, “you” or “your” refers to any individual or business accepted into the Programme.
By applying to, being accepted into, or participating in the Programme, you confirm that you have read and agree to these Terms.
Eligibility and Application
You must provide accurate and up-to-date information when applying to the Programme.
All applications are subject to approval by Homexdesign. We may accept or reject an application at our discretion, including where an applicant's content, website, social-media presence or promotional methods are unsuitable for the Homexdesign brand.
You must be legally capable of entering into these Terms and must comply with all applicable laws, regulations and platform rules.
Affiliate Links and Discount Codes
Approved Affiliates may receive a unique affiliate referral link and/or discount code.
Affiliate links and discount codes may only be used for genuine promotional activities permitted under these Terms.
You must not modify, manipulate or misuse affiliate links or tracking mechanisms in a way intended to interfere with accurate tracking or attribution.
You must not present yourself, your account, website or promotional material as an official Homexdesign account, website or communication channel unless expressly authorised by us.
Commission & Referral Attribution
The standard affiliate commission is 10% on qualifying sales.
Commission is calculated on the eligible order value after applicable discounts and excluding shipping charges and taxes.
The standard referral attribution period is 30 days from the applicable affiliate referral/click, subject to the Programme's tracking and attribution technology.
Commission is payable only on qualifying transactions that are successfully tracked and remain valid.
If a transaction cannot be properly attributed due to technical limitations, customer browser settings, deleted cookies or other circumstances outside our reasonable control, Homexdesign cannot guarantee that commission will be recorded.
Homexdesign may introduce different commission rates for specific products, Affiliates or promotional campaigns. Where applicable, such rates will be communicated through the Programme.
Customer Discount
Affiliates may receive a unique discount code providing customers with a 10% discount, subject to the applicable promotion.
Homexdesign may change, suspend or withdraw any discount code or promotional offer at any time.
Affiliates must accurately communicate the value, conditions and validity of any Homexdesign discount and must not advertise an expired or invalid offer as active.
Promotional & Social Media Rules
Affiliates may promote Homexdesign through their own social-media accounts, websites, blogs, videos and other legitimate promotional channels.
All promotional content must be truthful, accurate and consistent with these Terms.
Affiliates must clearly disclose their commercial relationship with Homexdesign whenever required by applicable law, advertising standards or the relevant platform's rules.
Disclosures must be clear, prominent and understandable. Appropriate disclosures may include “Affiliate”, “Ad” or “Advertisement”, where suitable for the platform and circumstances.
Affiliates must not make false, misleading or exaggerated claims about Homexdesign or its products.
Prohibited Activities & Paid Advertising
Affiliates must not:
- impersonate Homexdesign or represent themselves as an employee or official representative without permission.
- engage in spam, unsolicited bulk messaging or abusive promotional practices
- use fraudulent clicks, forced clicks, cookie stuffing, deceptive redirects or similar methods to generate commission;
- manipulate affiliate tracking, orders, customer information or Programme reporting;
- infringe the intellectual property, privacy or other rights of Homexdesign or any third party;
- create advertisements or accounts that could reasonably confuse customers into believing they are operated by Homexdesign.
Affiliates must not bid on or purchase paid search advertisements targeting Homexdesign trademarks, brand names, domain names or confusingly similar variations without prior written permission from Homexdesign.
Affiliates must not create paid advertisements that appear to be official Homexdesign advertisements.
Discount codes must not be distributed through unauthorised coupon databases, cashback schemes, browser extensions or similar services without prior approval.
Self-Referrals, Returns & Refunds
Affiliates may not use their own affiliate link or discount code to earn commission on their own purchases.
Affiliates must not use their affiliate link or code for purchases made on behalf of themselves or others where the primary purpose is to generate affiliate commission.
If an order is cancelled, returned, refunded, charged back or otherwise reversed, any commission associated with that transaction may be cancelled or deducted from future commission payments.
Homexdesign may delay commission payment where reasonably necessary to allow time for returns, refunds, cancellations or potentially fraudulent transactions to be identified.
Payments & Taxes
Eligible commissions will be paid using the payment method or methods made available through the Programme.
Payments are subject to verification of eligible sales and any applicable returns, refunds, cancellations, fraud checks or other adjustments.
Homexdesign may withhold or adjust payments where reasonably necessary to investigate suspected fraud, abuse, invalid transactions or breaches of these Terms.
Affiliates are responsible for any taxes, reporting obligations or other financial obligations applicable to their affiliate earnings.
Homexdesign may deduct or withhold amounts from payments where required by applicable law.
Intellectual Property & Content
Homexdesign and S.A. Brass Collection retain all rights in their trademarks, logos, product images, website content, branding and other intellectual property.
Approved Affiliates may use promotional materials supplied by Homexdesign solely for promoting Homexdesign through the Programme.
Affiliates must not alter or use Homexdesign branding in a manner that could mislead customers or damage the Homexdesign brand.
Affiliates remain responsible for content they create and publish.
Homexdesign may request that an Affiliate remove or correct content that breaches these Terms, applicable law or Homexdesign's intellectual-property rights.
Suspension & Termination
Homexdesign may suspend or terminate an Affiliate's participation if the Affiliate breaches these Terms or engages in conduct that may harm Homexdesign, its customers or its reputation.
An Affiliate may leave the Programme at any time by requesting termination of their account.
Following termination, the Affiliate must stop using Homexdesign affiliate links, discount codes, promotional materials and trademarks.
Termination does not affect rights or obligations that arose before termination, including Homexdesign's rights regarding invalid, reversed or fraudulent transactions.
Programme Changes & Liability
Homexdesign may modify, suspend or discontinue the Programme or any part of it, including commission rates, customer discounts, promotional methods or Programme requirements.
Where appropriate, material changes will be communicated to Affiliates through the Programme or their registered contact details.
Participation in the Programme does not guarantee any particular level of traffic, sales, commissions or income.
To the extent permitted by applicable law, Homexdesign and S.A. Brass Collection will not be responsible for indirect, incidental, consequential or special losses arising from participation in the Programme.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Governing Law, Contact & Acceptance
These Terms shall be governed by the laws of laws of India.
Any disputes arising in connection with these Terms or the Homexdesign Affiliate Programme shall be subject to the jurisdiction of the competent courts in India.
